Privacy Policy
What data do you hold?
The “Athlete Details” form contains your personal information (name, date of birth, contact details, address, occupation, etc.) and contact details for your next of kin.
The “Medical Questionnaire and Assumption of Risk Statement” form contains some your personal information (name and date of birth) together with the medical information you have provided to us.
If you have signed up to the “Maloney Performance Newsletter”, we will hold your name, email address and any optional data you choose to provide through the MailChimp sign-up form.
If you choose to opt it to the newsletter on the “Athlete Details” form, your name and email will be added to the MailChimp newsletter mailing list.
If you have emailed Sean Maloney and/or Maloney Performance directly, we will only save your name and email address to an Outlook contact list if directly requested (for example, if you’d like to be kept informed of workshops, competitions, etc.).
Bank details, credit/debit card numbers are not asked for unless specifically requested by you (for example, in the case of refunds). In such cases, these details are used immediately and will be deleted immediately after use.
How is my data used?
The “Athlete Details” form is used to ensure we have accurate contact details for you and for your designated next of kin who we may need to contact in the event of an emergency.
The “Medical Questionnaire and Assumption of Risk Statement” form is used to ensure your suitability for exercise. This is important to minimise any potential health and safety risks. In the event of an emergency, data from your Medical Questionnaire will be shared as requested by the emergency services (ambulance, police, fire, coastguard).
The “Maloney Performance Newsletter” will provide you with advice aimed to help your training or nutrition, together with news of upcoming events and any products/services which may be of interest to you.
Unless you have specifically opted-in to receive marketing messages (see below), you will only receive messages (email, text, smart phone application or phone call) relating to your training sessions (i.e. organisation of sessions, programmes, training check-ins, etc) and/or your effective ‘contract’ with Sean Maloney and/or Maloney Performance (i.e. changes to any payment structure, terms and conditions, etc.).
Unless you have specifically opted-in to have your training data (including any training videos and pictures) stored, no training data will be held. However, storage of training data will be required for any programming (either in person or online-only) services.
How can my data be used for marketing?
You can opt-in to receive marketing messages that we think will be of interest to you (i.e. workshops, training tips, research summaries) through one or more of the following channels:
Opting-in directly on the “Athlete Details” form to receive the “Maloney Performance Newsletter”
Signing up to the “Maloney Performance Newsletter” through MailChimp
Also, you may indicate directly (either within an email or other message, or verbally in-person) that you would like to be kept informed about a specific area (i.e. workshops, competitions, etc.). In this case, you will only receive the information that you request.
How do you collect data?
The “Athlete Details” and “Medical Questionnaire and Assumption of Risk Statement” forms may be completed either in-person using a paper form (one form), or online using Google Forms (two forms).
Subscription to the “Maloney Performance Newsletter” can also be completed using the MailChimp sign-up form.
Where is my data stored?
Where forms are completed online, data will be secured using a password-protected Google account. Where forms are completed in-person, paper forms will be stored in a locked filing cabinet. In both instances, only Sean Maloney will have access to the data.
How long is my data stored for?
Data from the online “Athlete Details” form will be deleted should you inform us by email (sean@maloneyperformance.com) that you will no longer be training with Sean Maloney and/or Maloney Performance. This data will also be routinely deleted if you do not train with Sean Maloney and/or Maloney Performance for a period of three years.
Data from the online “Medical Questionnaire and Assumption of Risk Statement” form will be stored for as long as you train with Sean Maloney and/or Maloney Performance, plus an additional three years.
Data from the physical “Athlete Details, Medical Questionnaire and Assumption of Risk Statement” form will be stored for as long as you train with Sean Maloney and/or Maloney Performance, plus an additional three years.
Data on the MailChimp platform will only be stored for as long as you remain subscribed to the “Maloney Performance Newsletter”.
Emails sent to Sean Maloney and/or Maloney Performance will be routinely deleted after a period of one year.
How can I access my data?
You are free to request any data that may still be held by emailing sean@maloneyperformance.com with the subject heading ‘Data Access’ and an outline of the data you would like to request. You will receive a response in no more than 21 days from your email. You will not be charged for any data request.
How can I change incorrect or outdated details?
You are free to request changes to any of your personal data by emailing sean@maloneyperformance.com with the subject heading ‘Data Update’ and an outline of the data you would like to update. You will receive a response in no more than 21 days from your email. You will not be charged for any data request.
In the event of a change in medical information, you will be required to complete a new “Medical Questionnaire and Assumption of Risk” form. The previous form will be held in line with the previously outlined conditions.
What happens in the case of any data breach?
In the event of any known data breach, you will be notified by email within 72 hours outlining the nature of the breach and any potential consequences.
Can I have my data removed?
You have the right to request that your data be removed from our records by emailing sean@maloneyperformance.com with the subject heading ‘Data Removal Request’. You will receive a response in no more than 21 days from your email. You will not be charged for any data removal.
You can remove yourself from the “Maloney Performance Newsletter” at any time by emailing sean@maloneyperformance.com with the subject heading ‘Newsletter Removal Request’ or by following the unsubscribe link the newsletter email.
